Hardie offshoot to pay asbestos settlement
Mesothelioma Diagnosis: A James Hardie subsidiary has agreed to pay an out-of-court settlement to a woman suffering from an asbestos-related disease. Anita Steiner, 45, is facing ongoing chemotherapy after being diagnosed with mesothelioma in early May. Today, lawyers for Ms Steiner and Amaca, a subsidiary of building products giant James Hardie, decided on an undisclosed settlement before the case was due to go to trial in the Victorian Supreme Court.
The Adelaide-born woman alleged she was exposed to deadly asbestos fibres 40 years ago while her parents built an office and unit next to their home in the Adelaide suburb of Torrens Park. The IT professional, who stopped working after her diagnosis, alleged she was exposed to asbestos fibres from cement sheeting used during construction.
Ms Steiner's health situation is described as stable after undergoing surgery to remove as much tumour surrounding her lungs as possible in May.

James Hardie appeal could prevent Banton settlement
Mesothelioma Diagnosis: Lawyers acting for the former James Hardie company have lodged a court appeal which could prevent settlement of a compensation claim for the seriously ill asbestos campaigner Bernie Banton. The appeal has been lodged against a claim which is intended to punish the former James Hardie company for its conduct.
On Monday the Court of Appeal will decide whether to hear an appeal against a dust diseases tribunal decision.
Yesterday the tribunal refused to strike out a claim for exemplary damages, which would be in addition to compensation for Mr Banton recently developing mesothelioma of the stomach.
His lawyer Tanya Segelov says it aims to punish James Hardie for its outrageous behaviour.
"There's also some suggestion from X-rays the company took that the company was aware that Bernie, while he was at James Hardie, could have been suffering from an asbestos disease," she said.
